PRIVACY POLICY

This Privacy Policy (hereinafter referred to as the ‘Policy’) defines the general principles and procedures for the processing of personal data and measures to ensure their safety in TRD LLC

TERMS AND DEFINITIONS

The Parties shall use the following terms in the following meanings:

  1. Website shall mean the site located in the Internet at http://tapisrouge.ru
  2. Subject of Personal Data shall mean an individual to whom Personal Data refer.
  3. Legislation shall mean the current legislation of the Russian Federation.
  4. Data shall mean other data about the User (not included in the concept of personal data).
  5. User shall mean any person who entered into a contractual relationship with the Operator.
  6. Operator shall mean any Employee of TRD LLC processing personal data, as well as determining the purposes of personal data processing, the composition of personal data subject to processing, actions (operations) to be performed with personal data.
  7. Personal Data shall mean any information relating to an individual (a User) directly or indirectly identified or to be identified.
  8. Automated Processing of Personal Data shall mean the processing of Personal Data by means of computer facilities.
  9. Personal Data Blocking shall mean temporary termination of personal data processing of (except for cases when processing is necessary for the specification of Personal Data).
  10. Access to Personal Data shall mean the familiarization of certain individuals with Personal Data processed by the Operator, provided that the confidentiality of this information is maintained.
  11. Information System of Personal Data shall mean a set of Personal Data contained in databases and information technologies and technical means ensuring the processing thereof.
  12. Confidentiality of Personal Data shall mean the duty of persons who have access to Personal Data to not disclose or distribute Personal Data to third parties without the consent of the User of Personal Data, unless otherwise provided by the federal law.
  13. Undeclared (Undocumented) Software Features shall mean software functionality not described or not corresponding to those described in the documentation, which can lead to a violation of the security characteristics of sensitive information.
  14. Personal Data Processing shall mean any action (operation) or a set of actions (operations) performed with or without the use of automation tools with Personal Data, including the collection, recording, systematization, accumulation, storage, сlarification (updating, modification), retrieval, use, transfer (distribution, provision, access), depersonalization, blocking, removal, destruction of Personal Data.
  15. Special Categories of Personal Data shall mean Personal Data relating to race, nationality, political views, religious or philosophical beliefs, health status, intimacy.
  16. Cross-Border Transfer of Personal Data shall mean the transfer of Personal Data to the territory of a foreign state, to the authority of a foreign state, to a foreign individual or to a foreign legal entity.

  1. GENERAL PROVISIONS

    1. policy regarding the processing of Personal Data is developed in accordance with the provisions of Federal Law "On Personal Data" No. 152-FZ dd. 27.07.2006 (as amended and supplemented), other legislative and regulatory legal acts, and determines the procedure for working with the Personal Data pertaining to Users and (or) transmitted by Users, as well as the requirements to ensure their security.
    2. Measures to ensure the security of Personal Data shall be an integral part of the Operator's activities.

  2. PRINCIPLES OF PERSONAL DATA PROCESSING

    1. Personal Data Processing shall be carried out by the Operator in accordance with the following principles:
      1. The legality and fair basis for Personal Data Processing. The Operator shall take all necessary measures to comply with the requirements of the Legislation, shall not process Personal Data in cases where this is not allowed by the Legislation, shall not use Personal Data to the detriment of the User.
      2. Processing only those Personal Data that meet the previously declared purposes of their processing. The correspondence of the content and amount of Personal Data being processed to the stated processing objectives. Preventing Personal Data Processing incompatible with the purposes of collecting Personal Data, as well as redundant in relation to the stated purposes of their processing. The Operator shall process Personal Data solely for the purpose of fulfilling the contractual obligations to the User.
      3. Ensuring the accuracy, adequacy and relevance of Personal Data in relation to the purposes of Personal Data Processing. The Operator shall take all reasonable measures to maintain the relevance of the Personal Data being processed, including but not limited to the implementation of the right of each Subject to receive his/her Personal Data for examination and to require the Operator to clarify, block or destroy them in the event that the Personal Data are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the above-stated processing purposes.
      4. The storage of Personal Data in a form that allows the User of such Personal Data to be identified no longer than the purpose of processing Personal Data requires, unless the period of storage of Personal Data is established by the federal law and/or a contract to which the User of the Personal Data is a party or beneficiary.
      5. Inadmissibility of combining databases of Information Systems of Personal Data created for incompatible purposes.

  3. TERMS AND CONDITIONS OF PERSONAL DATA PROCESSING

    1. Personal Data Processing by the Operator shall be allowed in the following cases:
      1. If the User has given the consent to process his/her Personal Data.
      2. If the Personal Data of the Subject of Personal Data are transferred by the User. The User shall ensure that he/she has previously obtained consent from the Subject of Personal Data for the transmission of data to the Operator.
      3. Personal Data shall be subject to publication or mandatory disclosure in accordance with the Legislation.
    2. The Operator shall not disclose or distribute Personal Data to third parties without the consent of the User, unless otherwise provided by the Legislation.
    3. The Operator shall not process Personal Data relating to Special Categories of Personal Data and to race and nationality, political views, religious or philosophical beliefs, the health status, the intimacy of the Subject of Personal Data, and the membership of the Subject of Personal Data in public associations, except in cases directly stipulated by the Legislation.
    4. The Operator shall not carry out Cross-Border Transfer of Personal Data, except for the cases directly stipulated by the Legislation.
    5. The Operator shall not take decisions that give rise to legal consequences with respect to the User or otherwise affect the rights and legitimate interests of Users exclusively on the basis of the Automated Processing of Personal Data. Data having legal consequences or affecting the rights and legitimate interests of Users shall be subject to verification by authorized employees of the Operator prior to their use.

  4. COLLECTION AND PROCESSING OF PERSONAL DATA AND OTHER DATA

    1. The Operator shall collect and store only those Personal Data that are necessary for the sale of goods through the Site and interaction with the User. At the same time, the collection of Personal Data can be carried out both through the Site and at fixed points of sales of the Operator.
    2. Personal Data may be used for the following purposes:
      1. Sale of goods to the User.
      2. Identification of the User.
      3. Interaction with the User.
      4. Sending advertising materials, information and inquiries to the User.
      5. Conducting statistical and other research.
    3. The Operator shall undertake to use Personal Data in accordance with the Federal Law "On Personal Data" No. 152-FL dd. July, 27 2006 and internal documents of the Operator.
    4. In respect of Personal Data and other User Data, their confidentiality shall be preserved, except where such data are publicly available.
    5. The Operator shall be entitled to keep an archival copy of Personal Data and other Data, including after the deletion of the User's account.
    6. The Operator shall be entitled to transfer Personal Data and other User Data without the User's consent to the following persons:
      1. State bodies, including the bodies of inquiry and investigation, and local self-government bodies at their reasoned request.
      2. The Operator's partners for the purpose of fulfilling contractual obligations to the User.
      3. In other cases, expressly provided by the current Legislation of the Russian Federation. 4.7. The Operator shall be entitled to transfer Personal Data and other Data to third parties not specified in Clause 4.6 of this Policy in the following cases:
      4. The User expressed his consent to such actions.
      5. The transfer is necessary within the framework of the User's use of the Site or within the framework of the performance of contractual obligations to the User.
      6. Transfer occurs within the framework of sale or other transfer of business (in whole or in part), while all obligations to comply with the terms and conditions of this Policy pass to the acquirer.
    7. The Operator performs Automated Processing of Personal Data and other Data.
    8. Access to the Information Systems containing Personal Data is provided by the password system. Passwords are set by authorized employees of the Operator and are individually communicated to the Operator’s employees who have access to Personal Data / Data.

  5. CHANGE OF PERSONAL DATA

    1. The User may modify (update, supplement) Personal Data through the Personal Area or by sending a written application to the Operator at any time.
    2. The User shall be entitled to delete Personal Data / Data at any time.

  6. CONFIDENTIALITY OF PERSONAL DATA

    1. The Operator shall ensure the confidentiality of Personal Data / Data processed by him/her in accordance with the procedure provided for by the Legislation. Confidentiality shall not be required for:
      1. Personal Data after their depersonalization.
      2. Personal Data, access of an unlimited circle of persons to which is provided by the User or at his request (hereinafter – ‘Personal Data Made Available to the General Public by the User’).
      3. Personal Data subject to publication or mandatory disclosure in accordance with the Legislation.

  7. USER’S CONSENT FOR PERSONAL DATA PROCESSING

    1. The User agrees to get the following data processed:
      1. Full name;
      2. Telephone number;
      3. Email address;
      4. Address.
    2. The User makes a decision to provide his/her Personal Data to the Operator and agrees to their processing freely, by his/her own will and in his interest. The consent to Personal Data Processing must be specific, informed and conscious and provided by the User at the time of its Registration at the Operator's Website, as well as in any form that enables to confirm its receipt, unless otherwise provided by the Legislation.
    3. Personal Data of persons, who entered into contractual obligations with the Operator, contained in unified state registers of legal entities and individual entrepreneurs, shall be open and public, with the exception of the information on the number of, date of issue of, and the body that issued, the document certifying the identity of the individual. The protection of their confidentiality and the consent of Users for processing shall not be required.
    4. In case of the receipt of requests from organizations that do not have appropriate powers, the Operator must obtain the User's prior consent for the provision of his/her Personal Data and warn those who receive Personal Data that these data can only be used for the purposes for which they are communicated, and also to demand from these persons the confirmation that this rule will (was) observed.

  8. RIGHTS OF SUBJECTS OF PERSONAL DATA

    1. The User shall be entitled to receive information regarding the processing of his/her Personal Data / Data. The User shall be entitled to require the Operator to verify his Personal Data, to block or to destroy them in the event that Personal Data are incomplete, outdated, inaccurate, illegally obtained or not necessary for the stated purpose of processing, and to take legal measures to protect his/her rights.
    2. If the User believes that the Operator carries out the processing of his/her Personal Data in violation of the requirements of the Legislation or otherwise violates his/her rights and freedoms, the User shall be entitled to appeal against the actions or inaction of the Operator in the authorized body for the protection of the rights of Subjects of Personal Data or in court.
    3. The User shall have the right to the protection of his/her rights and legitimate interests, including the compensation for damages and (or) compensation for moral harm in courts.

  9. PERSONAL DATA OF THIRD PARTIES USED BY USERS

    1. Using the Site, the User shall be entitled to enter data of third parties for subsequent use (Recipients of the Goods).
    2. The User shall undertake to obtain the preliminary consent of the Subject of Personal Data for their use through the Site.
    3. The Operator shall undertake to take the necessary measures to ensure the safety of Personal Data of third parties entered by the User.

  10. OTHER PROVISIONS

    1. The law of the Russian Federation is applicable to this Policy and the relations between the User and the Operator arising in connection with the application of the Policy.
    2. All possible disputes shall be resolved in accordance with the Legislation at the place of registration of the Operator.
    3. Prior to applying to the court, the User must observe the mandatory pre-trial order and send a relevant claim to the Operator in writing. The period for responding to such claim shall be thirty (30) working days.
    4. If, for one reason or another, one or more of the provisions of the Policy are deemed invalid or unenforceable, this shall not affect the validity or applicability of the remaining provisions of the Privacy Policy.
    5. The Operator shall be entitled to change this Policy at any time (in whole or in part) unilaterally without prior agreement with the User. All changes shall take effect the next day after posting the same on the Site.
    6. The User shall undertake to independently monitor the changes to the Privacy Policy by reviewing the current edition.
